Lawyer's Story
My name
is Terry Crouppen, I, along with my partner Ron
Brown, founded Brown and Crouppen almost 20 years
ago. There was never any doubt from the beginning,
that medical malpractice would be an area of the law
we wanted to concentrate in. Many lawyers believe
medical malpractice cases are the most
intellectually challenging in all of tort law. We
believe that a great law firm must work on the most
difficult cases; medical malpractice provides these
difficult cases every day.
Medical
malpractice is a problem that has reached almost
epidemic proportions in the United States. A recent
study funded by the federal government has
determined that up to 100,000 Americans die every
year as a result of medical malpractice. This means
that malpractice may kill more people each year than
motor vehicle accidents, aids or breast cancer.
Similar studies suggest that only one in ten acts of
malpractice are ever discovered by the victims. The
sum total of all these facts is that medical
malpractice is real, it injures and kills and
frequently is deliberately concealed.
A
successful malpractice case has two essential
elements. First, an act of malpractice (negligence)
by a medical professional or organization usually a
doctor, nurse, hospital or HMO. The second element
is an injury that is the direct result of the above
act of malpractice. It’s important to understand
that a case must have both to succeed. Malpractice
without injury means you don’t have a medical
malpractice case but more important you are a very
lucky person who encountered a “bad” doctor and
lived to tell about it.
At Brown
and Crouppen we want to answer your malpractice
questions. We know that modern medicine can be very
difficult to understand. Many successful cases begin
with just a suspicion following a bad outcome from
medical treatment. Just a “hunch” that something
wasn’t right. Over the years, I’ve learned to
listen carefully to these “hunches” they’re
often right on the money.
The following are a list of questions you might
consider in determining if you want to talk to us
further about medical malpractice.
- Have I, a member
of my family or a friend suffered a severe
injury or death while under the care of a doctor
or hospital?
- Was there a delay
in getting proper medical treatment because of a
failure to timely diagnose: a heart attack or
stroke; breast, colon, cervical or any other
forms of cancer?
- After talking to
another doctor, nurse or other health care
professional do you suspect that certain medical
treatment was inappropriate or that the outcome
of the treatment was in any way unusual?
- When you ask the
doctor, nurse or hospital questions regarding
the medical situation do you feel they are
hiding something?
- Has your medical
insurance company questioned the appropriateness
of any procedures, tests or diagnoses?
- Do you have any
questions about any of the prescription drugs,
other medicines, or any other medical devices or
products used as part of the medical treatment?

Donald and I were
never the kind of people to run to lawyers when we
had a problem. That’s why I waited before I
contacted Brown and Crouppen about a possible
medical malpractice case. None of the doctors ever
came forward and discussed why the tests were
misread, as a matter of fact no one would even admit
it had happened. I learned that when doctors and
hospitals mess up they cover up, at least that’s
what happened when I tried to get answers to my
questions.

Unfortunately, this
is true. There are definite time limits in taking
care of your case. These time limits are called
statutes of limitations and if you wait past this
time set out in the statute your case is over,
forever, regardless if you have gotten any money or
not. Don’t let this happen to you, if you have a
medical malpractice case don’t wait until it’s
too late, call Brown and Crouppen now.
